Diese Diplomarbeit beschäftigt sich mit dem Irrtum im Strafrecht und seine Problematik. Zweck der Arbeit ist die Wichtigkeit von diesem strafrechtlichen Institut zu betonen und seine Rolle im Rahmen des Strafrechts klarzustellen. Daraus entspringt auch seine sehr enge Verbindung zwischen dem Irrtum und dem Grundsatz der Subsidiarität der Strafrepression, auf welchen muss man in einigen Fällen des Rechtirrtums eine besondere Rücksicht nehmen. Der Irrtum des Straftäters ist für die Rechtstheorie wesentlich. Und es hat eine große Bedeutung auch für den Täter, weil es Einfluss auf seine strafrechtliche Verantwortlichkeit hat. In dem ersten Teil definiere ich erstens einige Begriffe, die wesentlich für das Verständnis des Irrtums sind und auf welche wir nicht verzichten können. In dem ersten Kapitel geht es um den Straftat. In dem zweiten Kapitel verlege ich mich mit der subjektiven Seite der Straftat und mit den Begriffen wie das Verschulden, der Vorsatz, die Fahrlässigkeit, der Versuch, die Vorbereitu ngshandlung und Weitere, also die meist mit Zusammenhang mit dem Strafrechtirrtum verwendeten Begriffe. In dem dritten Kapitel stelle ich kurz auch die Umstände, die die Widerrechtlichkeit beseitigen, vor. Kurzgefasst zahle ich auf, um welche es geht und was wir uns unter diese Begriffe vorstellen...

Mistake Abstract The final thesis discusses the issue of mistake in civil law. The aim is to map out in detail the background of the overly brief wording of the law, which is associated with a large number of interpretation problems. The main focus is on the means of inducing a mistake, the question of excusability and the importance of deceit and fraud in legal acts. The text is based on Czech and foreign scholarly literature and case law, especially of the Supreme Court. In the introductory chapters, the wording of law is set in a broader perspective. First, key principles for the interpretation, as well as theories dealing with the issue of the conflict between expression and will, are presented. Subsequently, the historical genesis of the laws on mistake is presented, which is of considerable importance for the subsequent interpretation. One of the pillars of the work is a theoretical division of specific types of errors. Further ways of inducing error are discussed. With the help of historical, logical and systematic interpretation, a conclusion is made about the need to bridge the textual imperfection of the law. The paper thematizes the concept of science in mid- and late thinking of Friedrich Nietzsche in the context of his understanding of scientific cognition of both: human and its world. The study introduces the problem of science and cognition in general in connection with significant motives of Nietzsche's thinking: morality, the revaluation of all values, thinking and living "beyond good and evil", freedom, human body, the superhuman motive, ascetic ideals, and more. Emphasis is put on the problem of veracity in the context of Nietzsche's attitude to idealism. (Mistake in civil law) The submitted diploma thesis deals with the problematic of mistake in civil law as a form of vitiated consent. Pivotal provisions are present in § 583-585 of the act No. 89/2012 Coll., civil law. In the introduction of the thesis we can find general issues of legal action, with more detailed description of will, its characteristics, manifestation of the will and their relation to each other, as these essentials of legal actions are instrumental for the purpose of this thesis. Next chapter focuses on the main issue, mistake as it defines it in two separate ways, that is discrepancy between the genuine will of the acting person and manifestation of the will, secondly as a defect of the will. Main focus of the thesis lies within the latter case, discrepancy between genuine will of the acting person is only mentioned briefly. Afterwards the thesis focuses on different types of mistake as corresponding to the provisions in the act No. 89/2012 Coll., civil law. Daniela Foltinová: Constantly Think: A Philosophical Interpretation of Thinking in Thomas Bernhard and Friedrich Nietzsche The thesis presents a philosophical interpretation on the problem of thinking acquired through the thorough analysis of Thomas Bernhards' novels Gehen, Verstörung and Alte Meister and an interpretation of knowledge, fallacy and thinking in the works of Friedrich Nietzsches' Menschliches, Allzumenschliches and Fröhliche Wissenschaft. The focal question of the thesis is: What does it mean to think? Interpretations of Bernhard held in three lines are always connected with the character in the novel. The fourth interpretation focuses solely on Nietzsches' thinking. There are four interpretations of thinking then. The first one characterizes thinking as a state of chaos taking place in the madmans' mind. The second one leads to the conception of reflective thinking of an observer. Both of them present a negative way of treating thinking as non-thinking. The third one with a storyteller taking thinkers' position shows procesual part of thinking: it is necessarily an activity with no further need for reflecttion or conceptualization. The aim of the thesis is to point out difficulties in interpretation of the civil code provisions (the act No. 89/2012 Coll.) regulating mistake as a form of vitiated consent and outline solutions to them on the basis of appropriate interpretation methods. The thesis applies to the legislation of mistake in relation to contracts in general as provided in the civil code, s. 583 - 585 and analyzes the legal consequences made by mistake. The keyword - mistake - is defined in the text in two ways - firstly as discrepancy between the genuine will of the acting person and manifestation of the will, secondly as a defect of the will. The study is primarily focused on the latter case. The text analyzes thoroughly conditions which must be satisfied so that so-called substantial mistake affects legal consequences. These conditions include determining circumstance, mistake caused by the second party and excusability of mistake. A separated chapter is devoted to mistake caused by fraud which is a special type of mistake because of its graveness, and therefore the act provides requirements which are different from those leading to the substantial mistake. Error in criminal law The aim of this thesis is a comprehensive analysis of the problems of error in criminal law, finding weaknesses in the current legislation and outline appropriate solution. By error any inconsistency of someone's imagination with reality is meant. Knowing the offender's error is a very significant for legal theory, in case of relevant criminal errors it is a very serious consequence for the subjective aspect of the crime. In the Czech criminal law, which is based on the principle of liability for fault, it is an issue, without which this concept was not complete and whose meaning would be fading away. This thesis classifies the problems of error in terms of current legislation, legal doctrine and relevant case law . The first chapter of this thesis is devoted to an explanation of the term error itself, its theoretical inclusion in the context of criminal law and explains its implications. It focuses on the concept of fault, especially its importance and its components, the two faces of it, which are intent and negligence, or on the concept of guilt. Knowing these two concepts is essential for the next orientation in the issue of errors, and indeed in criminal law at all.
